Hidden Defects
A real-estate transaction that turns sour

The Martels are sighing with contentment as they get cozily installed in their new home. The buying-selling-moving race is behind them! As they are starting to enjoy their home-honeymoon, the phone rings. At the other end is the new owner of their former home, who just found a serious problem and is holding them liable.

Judy and Michael are shaken. Everything was fine at selling time. They honestly declared all they knew about the house. For his part, the buyer had the house inspected. After the initial shock comes anxiety...

In the Province of Quebec, the Civil Code is quite clear on that matter, as follows:​

« The buyer has the right to expect that his reasonable expectations regarding the state of the property be protected. »

The legal text that expresses that responsibility is Article 1726 of the Civil Code of Quebec and reads as follows:

“The seller is bound to warrant the buyer that the property and its accessories are, at the time of the sale, free of latent defects which render it unfit for the use for which it was intended or which so diminish its usefulness that the buyer would not have bought it or paid so high a price if he had been aware of them.”

The warranty of quality, also called warranty against hidden defects, is the responsibility of the seller, even if he has no knowledge of the defects. In short, the warranty of quality required by the legislation makes the seller liable, whether the seller is of good faith or not in relation to the defects discovered.

Blower Door Test

The blower door test, which can be conducted under pressurization or depressurization, is an excellent diagnostic tool to measure the air tightness of a building and to conduct back-draft tests for chimneys, fireplaces and combustion appliances. The equipment used to conduct the test is called a blower door.

All energy efficiency programs based on the EnerGuide rating of the Government of Canada require a blower door test to measure the energy performance of a house, whether new or existing.

The blower door test is particularly useful with new construction to check the seal and the integrity of the vapour barrier before installing drywall. The certified consultant-evaluator conducting the test thus makes sure that the building is sufficiently airtight, not only to reduce discomfort of occupants and energy waste, but also to avoid important moisture infiltration in walls.

We recommend, for consumer protection, that all new homes built according to the Quebec Construction Code are blower door tested before the drywall is installed.

Scanning a building under depressurization from a blower door with an infrared camera is a good investigative technique. Using both the blower door and the infrared camera, it is possible to quickly pinpoint anomalies such as air infiltration and the presence of excessive humidity inside walls.

Thermography

Thanks to infrared cameras, there is no longer a need to open walls and search awkward spaces of a house to pinpoint problems. The equipment can detect problems through covering materials without having to break anything!

Such a very special camera can detect

  • Defects of the seal and thermal insulation of the building envelope
  • Water infiltration in the foundation or the roof
  • Condensation inside walls
  • Leaks in some heating systems
  • And more.

What is thermography?

Thermography is a technique that records the temperature of objects and materials with infrared rays. Infrared cameras record temperatures of different points of a surface being scanned.

The measurement results appear as a colour-coded image called a thermogram.

Anomalies appear as colder or warmer colour points on the surface. For example, a blue patch on a wall scanned from inside the house in winter could indicate a lack of thermal insulation.

In such a case, a scan of the same wall taken outdoors would show the same patch in warm colours because of the heat loss.

How is the data interpreted?

Analyzing a thermograph is complex. Many factors have to be considered when interpreting data. To understand what the colours mean, one has to take into account, among others, radiancy characteristics of materials. For example, aluminum and brick do not capture or radiate heat the same way. One does not become a thermography specialist overnight. A person needs a rigorous approach and competence to obtain valid results. Images must be gathered and interpreted by an expert certified by the American Society for Nondestructive Testing (ASNT). (Source: CAA-Quebec)
